GENERAL CONDITIONS OF SALE

All orders placed via the Internet at the website www.salumibenvenuti.com (hereinafter, " Salumi Benvenuti "), are governed by these General Conditions of Sale (hereinafter, "Conditions of Sale"), formulated in accordance with current legislation on contracts concluded outside the commercial headquarters. By submitting an order, you declare that you have read, understood and accepted these General Conditions of Sale. Salumi Benvenuti reserves the right at any time to modify these General Conditions of Sale by publishing the new version on the website www.salumibenvenuti.com (hereinafter, the Site). The applicable General Conditions of Sale are those in force at the time the order is placed. These Conditions of Sale have the objective of regulating the purchase of products and services made available by the Site in compliance with Italian legislation on distance contracts (Legislative Decree 70/2003).


PROPERTY AND SELLER

The site is owned by Salumi Benvenuti S.r.l. with registered office in Via della 1225/C, Santissima Annunziata Street, LUCCA CAP 55100 – LU – C.F./P.I.00142430461, REA LU – 82064. The Customer is required to read the Conditions of Sale carefully before sending the order. These Conditions of Sale have been made available on the Site to allow reproduction, understanding and storage. The contracts concluded with Salumi Benvenuti S.r.l. through the Site are governed by these Conditions of Sale in compliance with Italian law. The seller is: Salumi Benvenuti S.r.l. HOW TO BUY

The price of the various Products as well as the related descriptions and characteristics are shown on the page relating to each Category and in detail on the page of each Product. For the purchase of the Products, the Customer must add the Product to the "Shopping basket" and then fill in and send the order form in electronic format, entering the billing and shipping data following the instructions contained in the Site. After declaring their consent, by selecting appropriate fields, to the processing of their data, the customer will be asked to confirm that he has read the Privacy policy, before proceeding with the choice of shipping method and proceeding with payment. To conclude the purchase, you will also be asked to read and accept these general conditions of sale. Once an order has been submitted, an Order Confirmation page will appear to the customer. This order confirmation has the value of a contractual proposal and with it the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these Conditions of Sale and payment. The contract stipulated between Salumi Benvenuti and the Customer must be considered concluded with the acceptance of the order by Salumi Benvenuti. This acceptance is communicated to the Customer through an e-mail confirming the order itself to the address indicated by the customer during registration and / or conclusion of the order. On the www.salumibenvenuti.com Website there is a minimum purchase order value of € 29.00. The Customer is also offered the opportunity to take advantage of free shipping for orders over € 99 including VAT for shipments in Italian territory and € 299 in European territory. The prices shown on the Website are all inclusive of VAT and expressed in euros, the only currency accepted by Salumi Benvenuti. The applicable prices for the products ordered are those that appear on this site on the date of transmission of the order. These prices are inclusive of VAT. Shipping costs are not included.


DELIVERY COSTS

Delivery costs are invoiced on the basis of the rates indicated on this site on the date on which the order is placed. These rates are defined according to the size of the order, and the method of delivery, the location and the country of residence. Salumi Benvenuti reserves the right to modify prices and shipping costs at any time and to cancel an order in case of obvious error in the calculation system or in the data. Salumi Benvenuti makes shipments throughout the national territory. Any order that arrives with a foreign destination will not be accepted by the system and in any case will not be processed. Any payment received will be refunded to the customer, net of collection and subsequent sending costs incurred. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance or evasion, even partial, of an order. The visual and photographic representations of the products on the Site are only in support of the description sheet. It is understood that the photographic image of the products has the sole purpose of presentation for sale and may not be perfectly representative of its characteristics but differ in color and / or size. In case of difference between the image and the written product sheet, the description of the product sheet is always authentic. Salumi Benvenuti promotes responsible trade and excludes any liability at its own expense in the case of purchase made by children under 16 years of age.


PAYMENTS

The Customer will be able to make the payment of the price of the Products and the related delivery costs by PayPal or by bank transfer.

PayPal: To ensure maximum security, the Customer will carry out the payment transaction directly on the secure server of PayPal: once the order has been confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his PayPal account.

Bank transfer: The transfer must be made using the bank details below. Salumi Benvenuti will process the order only after having received confirmation from its bank of the transfer or after the Customer has communicated by e-mail the CRO number issued by the bank at the time of the transfer order.

ORDER MANAGEMENT

Once the order has been received, Salumi Benvenuti will check the stocks for availability and will proceed to process the order as soon as possible. The Customer, upon receipt of the order by Salumi Benvenuti which corresponds to the execution of the contract, receives an e-mail confirming the taking charge of the purchase order sent. The communication contains the order number, the date, the summary of shipping and billing data, the list of products ordered with their essential characteristics, their price and the amount paid.


SIZES AND WEIGHTS OF THE PRODUCTS PURCHASED

The products made and sold by Salumi Benvenuti S.r.l. are handcrafted and therefore the net weight of each product may vary with respect to the weight indicated in the product sheet. To offer a quality service to our Customers, Salumi Benvenuti undertakes to make sizes slightly higher than what is reported on the website, therefore the product that will be delivered to you will always have a weight equal to or greater than that indicated on the product sheet.


RIGHT OF WITHDRAWAL (CONSUMER CODE D.LGS 206/05 AND D.L. 21/2014)

Salumi Benvenuti guarantees that products equal to those indicated and described on the site will be delivered and compliance with all the rules regarding the storage of products until the time of delivery to the place indicated in the order. For all products sold, the responsibility of the manufacturer applies. In the case of packaged products Salumi Benvenuti S.r.l. is also responsible for the truthfulness and completeness of the information on the packaging. The images on the site and on the packaging are provided to the Customer to facilitate the recognition of the products; due to variations in packaging, photos may not exactly reflect the appearance of the delivered product. The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except in the cases of exclusion provided for in point IV below. To exercise this right, the Customer must send Salumi Benvenuti a communication within 14 days from the date of receipt of the Products using the form downloadable here or, if he intends to exercise the withdrawal before receiving the Products, the notice of withdrawal may be sent at any time before their receipt.

The Customer Service of Salumi Benvenuti will provide, once the communication has been received, to open a file for the management of the return and to communicate to the Customer the instructions on how to return the Products, which will take place by courier indicated by Salumi Benvenuti.


The right of withdrawal is governed by the following conditions:

I. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of several components or parts, it is not possible to exercise the withdrawal only on part of the Product purchased.

II. In case of exercise of the right of withdrawal Salumi Benvenuti will reimburse the customer the full amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the notice of withdrawal was received, without prejudice to the right of Salumi Benvenuti to suspend the payment of the refund until the actual receipt of the goods. The refund will be made using the same payment method used by the Customer, unless he has expressly requested a different method. In case of transfer, the Customer will provide the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN).

III. Also in order to guarantee the free return, the Products must be returned in the same box in which they were received.

IV. In addition to the cases indicated in the Introduction (non-consumer customer and / or requesting the invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 D.lgs. 21/2014:

– order of Products made to measure or clearly personalized;

– order of Products that are likely to deteriorate or expire rapidly;

– order of sealed Products that do not lend themselves to being returned for hygienic reasons or related to health protection or that have been opened after delivery.


With reference to the cases of exclusion of withdrawal listed above, the Customer, in particular, is informed and accepts that among the Products that "risk deteriorating or expiring rapidly" include all food Products (including wines, spirits and beverages), as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for reasons of hygiene and protection of Customers, the right of withdrawal is applicable only for products purchased on the Site that can be returned to Salumi Benvenuti and put back on the market without danger to the health of consumers. In cases of exclusion of the right of withdrawal, Salumi Benvenuti will return the Purchased Products to the Customer, charging the same shipping costs. According to Article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can make use of the Joint Conciliation procedure. The Procedure can be initiated if the consumer after submitting a complaint to the company, within thirty days, has not received a response or has received a response not considered satisfactory by him. SHIPMENTS

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure. Salumi Benvenuti registers every order placed on the Site and will send the Customer a purchase receipt in electronic format to the e-mail address indicated during the purchase. For each shipment, a regular invoice will be issued on the basis of the data entered by the Customer in the personal data. It will not be possible to make any changes to the invoice after it has been issued. All purchases will be delivered by courier at controlled temperature STEF ITALIA (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. Salumi Benvenuti is not responsible for unforeseeable delays, inefficiencies or non-deliveries by the Courier. Once the Products have been shipped, Salumi Benvenuti will notify the Customer by means of a notification in its Reserved Area and / or by e-mail of the shipment of the goods and the related tracking link. Except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered, in Italy, within a period of 7 (seven) working days starting from the day following receipt of payment and the relative order confirmation e-mail, unless Salumi Benvenuti communicates – within the aforementioned term – the impossibility of delivering the ordered goods as a result of the unavailability, even temporary, of the Products. In case of such communication, the Customer will have the opportunity to wait for the new availability of the missing product or to choose one or more alternative products. In the event that the Customer decides not to choose alternative Products or to cancel the order, Salumi Benvenuti will refund any sums already paid by the Customer within the same terms of time. The information relating to the Products provided through the Site is constantly updated, but it is not possible to guarantee the complete absence of errors. Salumi Benvenuti reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior notice.

APPLICABLE LAW AND JURISDICTION

The sales contract between the Customer and Salumi Benvenuti S.r.l. is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction is that of the forum of Lucca.
